In this policy, "we", "us" and "our" mean B2B Pulse Pty Ltd. "Personal information" has the meaning given to it in the Privacy Act 1988 (Cth).

 

We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth). Where we handle the personal information of individuals in New Zealand, we also comply with the Information Privacy Principles in the Privacy Act 2020 (NZ). 

1. Who we are and what we do 

B2B Pulse is a business-to-business email distribution service. We maintain a contact database of professionals across Australia and New Zealand, and we distribute targeted business updates, events and commercial opportunities to relevant parts of that audience on behalf of advertisers. 

We are a small business operator that collects personal information from third parties in connection with our services. On that basis we are treated as an APP entity under the Privacy Act 1988 (Cth) and this policy is provided in accordance with Australian Privacy Principle 1.

2. The personal information we collect

We collect information about individuals in a professional capacity. The information we hold may include: 

  • Name, including first and last name 

  • Business email address 

  • Business telephone number 

  • Job title, role and seniority level 

  • Employer or organisation name 

  • Industry and sector 

  • Business location, including city, state or region, and country 

  • Records of how you have interacted with our emails, such as whether a message was delivered, opened or clicked, and when 

  • Your communication preferences, including any request to unsubscribe 

  • For advertisers and enquirers, the information you provide to us when you contact us or request our media kit 

Information we derive 
In addition to the information described above, we generate further professional attributes about the contacts in our database. For example, we may infer an industry classification from an organisation’s email domain, assign a seniority level based on a job title, or allocate a contact to one or more audience segments. Information we generate in this way is also personal information, and it is covered by this policy. 

Information we do not collect 

We do not collect sensitive information as defined in the Privacy Act 1988 (Cth). This includes information about health, racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, trade union membership, sexual orientation or practices, criminal record, or biometric data. 

We do not collect government-related identifiers such as tax file numbers, driver licence numbers or passport numbers. We do not collect or store payment card numbers. 

3. How we collect personal information 

Directly from you 

We collect information directly from you when you subscribe to our updates, complete a form on our website, request our media kit, attend or register for an event we promote, correspond with us by email, or otherwise provide your details to us. 

From third parties 

We also obtain business contact details from reputable business data providers. Where we collect your personal information from a source other than you, we take reasonable steps to make you aware that we hold it, and every message we send identifies us as the sender and provides a means of unsubscribing. 

Automatically, when you use our website or open our emails 

When you visit our website or open an email from us, we may automatically collect technical information such as your IP address, browser type, device type, the pages you viewed and the time of your visit, and whether a message was opened or a link was clicked. Section 8 explains how we use cookies and similar technologies. 

Dealing with us anonymously 

You may ask a general question about our services anonymously or under a pseudonym. We may not be able to respond to some enquiries, or to provide our services, without knowing who you are and how to contact you. 

4. Why we collect and use personal information 

We use personal information for the following purposes: 

  • To distribute relevant business updates, events and commercial opportunities by email 

  • To determine which audience segments a message is relevant to, so that we send fewer and more relevant messages 

  • To measure how our campaigns perform and to report on that performance in aggregate 

  • To maintain the accuracy and quality of our database 

  • To respond to your enquiries and to provide our services to advertisers 

  • To manage unsubscribe requests and communication preferences 

  • To meet our legal and regulatory obligations, including under the Spam Act 2003 (Cth) and the Unsolicited Electronic Messages Act 2007 (NZ) 

We do not use personal information for any purpose that is unrelated to the purposes described above, unless you would reasonably expect us to do so, you have consented, or we are required or authorised by law. 

5. Who we share personal information with 

We do not sell, rent or trade your information 

We do not sell, rent or trade the personal information of the people we send to. This applies without exception. 

Advertisers 

Advertisers who run campaigns through B2B Pulse do not receive your personal information. Advertisers receive aggregate campaign reporting only, which describes overall performance such as the number of messages delivered, opened and clicked. Advertisers are not given recipient-level data, and are not told which individuals received, opened or clicked a message. 

If you choose to respond to an advertiser by clicking through to their own website and providing your details there, that information is collected by the advertiser under their own privacy policy, not ours. 

Service providers 

We share personal information with third parties who provide services to us, including our customer relationship management platform, our email delivery platform, and our website hosting platform. These providers are permitted to use the information only to provide services to us, and we require them to protect it. 

Other disclosures 

We may disclose personal information where we are required or authorised to do so by law, where it is necessary to investigate a suspected unlawful activity or a serious threat to safety, or in connection with the sale or restructure of our business, in which case the recipient would be bound by this policy. 

6. Overseas disclosure 

Some of the service providers we rely on store or process personal information outside Australia and New Zealand. At the date of this policy, this includes: 

  • Our customer relationship management platform, HubSpot, in the United States 

  • Our email delivery platform, in the United States 

  • Our website hosting platform, Wix, in the United States and Israel 

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the recipient handles it in a manner consistent with the Australian Privacy Principles. You should be aware that overseas recipients may be subject to laws that differ from those in Australia and New Zealand, and that we may not always be able to control how information is handled once it is outside Australia. 

If our service providers change, we will update this section.

7. Direct marketing and how to opt out 

The emails we send are commercial electronic messages. Every message we send: 

  • Clearly identifies B2B Pulse as the sender 

  • Includes our business contact details 

  • Includes a functional unsubscribe facility 

You can unsubscribe at any time using the link in any message we send, or by emailing us at hello@b2bpulse.com.au. We action unsubscribe requests promptly and in any case within the time required by law. Once you unsubscribe, we retain a minimal record of your email address for the sole purpose of ensuring you are not contacted again. 

You may also ask us to tell you where we obtained your contact details. We will respond to that request within a reasonable period, and free of charge. 

8. Cookies and website analytics 

Our website is hosted on Wix, which sets cookies that are necessary for the website to function, including for security and to remember your preferences. 

We may in future use analytics and advertising technologies on our website, such as website analytics tools and social media advertising tags, to understand how our website is used and to measure the effectiveness of our own marketing. Where we do so, we will update this policy and, where required, seek your consent before those technologies are used. 

Most browsers allow you to refuse or delete cookies. If you block cookies, some parts of our website may not work as intended. 

Our emails contain a small image that allows us to record whether a message was opened, and links that allow us to record whether they were clicked. We use this to measure campaign performance and to understand which contacts remain engaged. You can prevent open tracking by configuring your email client not to load remote images.

9. How we keep information secure 

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls that limit who within our business can view contact data, the use of reputable service providers with established security practices, and secure transmission of data between systems. 

No method of transmission or storage is completely secure. If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme, and the Office of the Privacy Commissioner in New Zealand where that scheme applies. 

10. How long we keep information 

We keep personal information only for as long as it is needed for the purposes set out in this policy. 

Where a contact has not engaged with any of our emails for 24 months, we remove their details from our active database. We may keep information for longer where we are required to do so by law, or where it is necessary to resolve a dispute or enforce our agreements. 

Where information is no longer needed, we destroy it or de-identify it. 

11. Accessing and correcting your information 

You have the right to ask us: 

  • What personal information we hold about you 

  • To provide you with a copy of it 

  • To correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading 

  • To delete it from our database 

To make a request, email us at hello@b2bpulse.com.au. We will respond within a reasonable period, and generally within 30 days. We do not charge for making a request. We may ask you to verify your identity before we act on it. 

If we refuse a request for access or correction, we will tell you why in writing and explain how you can complain about that decision.

12. Complaints 

If you think we have breached your privacy or mishandled your personal information, please contact us first at hello@b2bpulse.com.au. Set out what happened and how you would like it resolved. We will acknowledge your complaint promptly, investigate it, and respond to you in writing, ordinarily within 30 days.

13. New Zealand contacts 

If you are in New Zealand, the Privacy Act 2020 (NZ) applies to our handling of your personal information alongside the Australian Privacy Principles. Your rights of access, correction and complaint under that Act are substantially the same as those described in sections 11 and 12 above, and can be exercised by contacting us at hello@b2bpulse.com.au

Commercial electronic messages we send to New Zealand addresses comply with the Unsolicited Electronic Messages Act 2007 (NZ), including sender identification and a functional unsubscribe facility. 

14. Changes to this policy 

We may update this policy from time to time to reflect changes to our practices, our service providers or the law. The current version is always available at www.b2bpulse.com.au. The effective date at the top of this policy tells you when it was last updated. Where a change is significant, we will take reasonable steps to tell you.
